Port Stephens Contaminated Lands Policy

This policy was developed to ensure the potential for land contamination is addressed in the decision-making processes undertaken by Council.
It has been developed in accordance with the “Planning Guidelines for Contaminated Land” produced by the Department of Urban Affairs and Planning and the Environment Protection Authority and with consideration of s145A of the Environmental Planning and Assessment Act 1979, the Contaminated Land Management Act 1999 and State Environmental Planning Policy 55 – Remediation of Land. The principles of the policy are:- - Contaminated land should not be developed without adequate assessment of the risks and satisfactory remediation where appropriate.
- Land use and purchase decisions are best made with knowledge of potential environmental and human health risks.
- Development Consent under the EP&A Act 1979 should not permit building or development on contaminated land without adequate assessment of the environmental and human health risks and appropriate remediation where necessary.
